Trial in sword-attack case delayed
Kyle Brennan McCoy, 34, of Fredericton, will remain in custody until his new trial date, set for mid-September, on domestic-violence allegations
A Fredericton man whose trial on charges alleging domestic violence was delayed because of a change in defence counsel will now stand trial this fall.
Kyle Brennan McCoy, 34, of Irvine Street, previously elected to be tried in provincial court and pleaded not guilty to a number of charges.
He’s accused of assaulting Amber Hawkins, assaulting her with a sword, assaulting her by choking her, confining her unlawfully, threatening to cause her death and/or bodily harm and breaching a probation order, all between Dec. 26 and Jan. 5 in Fredericton.
When he entered those pleas earlier, he was free on conditions, so his trial was scheduled for March 20, 2024.
But that trial date got bumped up to May 17 after he was arrested in Woodstock and his release order was revoked.
However, that earlier trial date has come and gone, because McCoy went through a change in defence counsel.
Originally represented by legal aid staff lawyer Edward Derrah, he’s now represented by Woodstock-area lawyer Lindsay Paul.
McCoy appeared in Fredericton provincial court by telephone from jail Wednesday so his trial could be rescheduled.
Judge Scott Brittain set the trial down for Sept. 15, and he remanded McCoy again until that time.
