Vaping plaintiffs seek injunction again
Quartet suing over flavour ban want to halt product seizures by enforcement officers
A group suing the provincial government over its ban on flavoured-vaping liquids now wants a judge to put a stop to enforcement efforts that have seen illegal products seized from retailers.
Kayleigh Miller, Anthony Miller, Donald Vosburgh and Roderick Pollard filed a lawsuit against the province in the fall of 2021 after the government enacted its ban on flavoured vaping liquids, except for tobacco flavours.
The flavour ban is meant to curb vaping among youth, but the plaintiffs have argued the flavoured liquids allow smokers to quit the more dangerous habit, and their elimination will send people back to cigarettes.

Court of King’s Bench Chief Justice Tracey DeWare held a case-management conference in the matter Tuesday after the court received a letter from Mel Norton, one of the lawyers representing the plaintiffs.
