Editor’s note: Jacob Cole was later acquitted of the charges against him after significant problems arose in the complainant’s testimony, with the Crown conceding the defendant should be found not guilty.

A different defence lawyer than the one a Scotchtown man hired to represent him on an allegation of sexual assault on a child will handle his jury trial this fall, a court heard Tuesday.

Jacob Cole, 20, of Cottage Lane, faces indictable charges of sexually assaulting a minor and touching that same child for a sexual purpose, alleged to have occurred Aug. 8, 2022, in Richibucto Road, also known as the Pepper Creek area of Fredericton.

During an earlier appearance on the file, Cole elected to be tried in the Court of King’s Bench by a judge and jury, and lawyer Adrian Forsythe appeared at the King’s Bench motions day Tuesday to confirm trial dates.
