Trial date bumped up in sword-attack case
Kyle Brennan McCoy, 34, of Fredericton, was detained in custody, prompting acceleration of his court dates on charges alleging domestic violence
A Fredericton man previously given a trial date next year on domestic-violence charges will get before a judge much sooner as he’s since been remanded into custody.
Kyle Brennan McCoy, 34, of Irvine Street, elected to be tried in provincial court and pleaded not guilty in Fredericton provincial court Feb. 27 to several charges.
Those counts alleged he assaulted Amber Hawkins, assaulted her with a sword, assaulted her by choking her, confined her unlawfully, threatened to cause her death and/or bodily harm and breached a probation order, all between Dec. 26 and Jan. 5 in Fredericton.
McCoy was free on conditions when he pleaded not guilty, and the court scheduled his trial for March 20, 2024.
However, since that last appearance, McCoy was arrested in the Woodstock area, and his release was revoked.
He appeared again in Fredericton provincial court by telephone from a remand facility Thursday to address the trial date issue.
“Mr. McCoy, because you are in custody, you do become eligible for an earlier trial date,” Judge Natalie LeBlanc said Thursday.
She rescheduled the trial for May 17.
“I’m very pleased with that date,” the defendant said.
