New Brunswick Court of Appeal blasts impugned judge, Fredericton police officers for out-of-court conduct during drug-trafficking prosecution against Scott Alexander Morrison, 41
The New Brunswick Court of Appeal has issued a scathing criticism not only of an impugned judge who engaged in misconduct but of the police witnesses involved for being oblivious to how inappropriate it was.
The province’s top court granted a stay of proceedings of June 18, 2021, charges against Scott Alexander Morrison, 41, formerly of Geary.
Morrison had sought the stay as a result of judicial misconduct committed by former provincial court judge Kenneth Oliver, who ended up retiring last year rather than go through a judicial misconduct hearing.
Chief Justice Marc Richard said Oct. 10 that reasons for the appeal court’s decision would follow, and the court issued those full reasons in a decision published Thursday.
