Sheffield man denies sex assault, registration charges
David John Nolais, 61, of Sheffield, will stand trial next year for alleged sex crime, accusations of violating the terms of his sex-offender registration order
A registered sex offender accused of committing another sexual offence and repeatedly violating the terms of his registration order will stand trial on five charges next year.
David John Nolais, 61, of Route 105 in Sheffield, appeared in Fredericton provincial court Wednesday with defence counsel Edward Derrah to answer to five counts.
Nolais elected to be tried in provincial court and pleaded not guilty to four counts of breaching the terms of a court order issued under the Sex Offender Information Registration Act (SOIRA), as well as one summary charge of sexual assault.
The latter is alleged to have occurred in Oromocto on Jan. 1.
The name of the complainant in that case is protected by a court-ordered publication ban.
The alleged SOIRA violations are that he provided a police officer handling registration duties with false information on Jan. 7, 2022, about where he was living; that he didn’t report a change of address to the registry within seven days of moving July 8; that he again provided false details about he was living Nov. 18; and that he failed to report on Dec. 6 that he got a job working at Tim Hortons on Restigouche Road in Oromocto.
Judge Natalie LeBlanc scheduled the trial on the SOIRA-related charges for Jan. 16, and the sexual-assault trial for April 24.
Nolais was convicted in 2015 and jailed for soliciting a teenage boy for sex, and it was that conviction that carried with it a 10-year SOIRA order.
At the time, court heard Nolais was working as a cab driver in Fredericton on March 21, 2009, when a 16-year-old boy got in his taxi a fare.
He chatted the boy up, court heard during the sentencing hearing, asking about the boy’s sexuality and propositioning him. Nolais offered the teen cash and a free cab ride in exchange for sex.
