Registered offender faces new sexual-assault charge

A Sheffield man ordered to register as a sex offender for sexually propositioning a teenage boy in 2009 now stands charged with committing a sexual assault in Oromocto earlier this year.
David John Nolais, 61, of Route 105 in Sheffield, appeared in Fredericton provincial court Wednesday for his initial appearance on a summary charge of sexual assault, alleged to have occurred in Oromocto on Jan. 1.
Judge Lucie Mathurin ordered a publication ban on any information that would tend to identify the complainant.
Nolais appeared in provincial court March 31 to face three counts of violating the conditions of a Sex Offender Information Registration Act (SOIRA) order imposed on him in April 2015 for 10 years.
Those charges alleged he provided a police officer with false information on Jan. 7, 2022, about where he was living; that he failed to update the registry within seven days of a change in residence July 8; and provided false residential information again Nov. 18.
During his Wednesday court appearance, Nolais had to answer to another alleged breach of his SOIRA order: failing to report a change in employment - that he was working at Tim Hortons on Restigouche Road in Oromocto - on Dec. 6.
Mathurin asked the accused what he planned to do about the previous charges and two new counts before the court.
“I’m waiting on legal aid, your honour,” Nolais said.
The judge told him to contact New Brunswick Legal Aid to add the new charges to his application for counsel.
She adjourned the charges to May 10 for pleas.
Nolais was jailed in April 2015 for several offences, including solicitation of a teenage boy for sex.
During his sentencing hearing, court heard Nolais was driving cab in Fredericton on March 21, 2009, when he picked up a 16-year-old boy as a fare.
The offender engaged in conversation about the boy’s sexuality and propositioned him, offering cash and a free cab ride for sex.
It was that crime that led to his SOIRA order.

He is a pedophile and likes little boy's . Sad for any kid around him . He shouldn't be aloud to work with anyone under 18 years old or even be around anyone under 18 alone . I don't need a judge to tell me he has done this as he now has done it multiple times. Let's hope if they find him guilty he get's jail time and a record to show he is a pedophile . I no he is not guilty yet lol
