Manslaughter suspect, lawyer miss court
Tyler Totten, 19, of Lower Truro, N.S., and defence counsel Brian Munro were set to appear in provincial court for pre-inquiry hearing Monday, but neither could be reached by phone
One of four defendants in a manslaughter case arising from an incident in Fredericton’s bar district last fall was a no-show in court for a pre-trial conference Monday, as was his defence lawyer.
Tyler Totten, 19, of Lower Truro, N.S., was charged with manslaughter stemming from the September death of André Bourgeois after an alleged assault in the Tannery, a courtyard outside of several downtown bars.
Also charged with the same offence were three youths, whose identities are protected under the provisions of the Youth Criminal Justice Act. That trio is charged jointly, but Totten, who was 18 at the time of the incident, is being prosecuted solo since he’s under the jurisdiction of adult court.
Totten previously elected to be tried in the Court of King’s Bench by a judge and jury on the manslaughter charge, and his preliminary inquiry is scheduled for June 20, June 27 and July 11.
