Local couple loses case against airline
Barry & Carrie Winters filed small claim against Air Canada for losing their luggage in 2022, but adjudicator rules “sneaky” release included with etransfer resolved compensation issue
A Fredericton-area couple’s depositing of an etransfer from Air Canada for what they thought was a partial payment for losses incurred on a California vacation turned out to be a binding settlement.
Barry and Carrie Winters filed a case in small-claims court in Fredericton last year against the airline over their lost luggage, which they had to do without for basically the entirety of their trip to California two years ago.
They argued they incurred out-of-pocket expenses totalling $2,312.63 throughout their time on the west coast of the United States in 2022.

Evidence filed with a small-claims adjudicator showed Barry Winters filed a detailed list of the reasonable expenses he had to charge to his credit card, and he filed an online baggage claim with Air Canada as he was required to do for reimbursement.
