Lawsuit against private university to continue
Judge rules former Yorkville University student’s lateness in serving it with court action shouldn’t stop effort to litigate disputes regarding practicum requirements, failing grade
A graduate student’s lawsuit against a Fredericton-based, private-sector university can continue, a judge has ruled, explaining that a delay in serving it wasn’t the plaintiff’s fault.
Ryan Bazylak filed a notice of action and statement of claim against Yorkville University in the Court of King’s Bench (then Queen’s Bench) in Fredericton in August 2019.
Yorkville has yet to file a statement of defence in the case, but the matter was before Court of King’s Bench Justice Terrence Morrison earlier this year, as counsel for Bazylak filed a motion for extension of time to serve the notice of action and statement of claim on the defendant.
In the lawsuit, the plaintiff alleged there were obstructionist moves on the private educational institution’s part that prevented him from getting a master of arts degree in its counselling psychology program back in 2014.
