Judge dismisses 2011 jail assault lawsuit
Thomas William Jack, 45, of Fredericton, sought damages due to sustaining brain injury inflicted by another prisoner while remanded at Saint John jail more than decade ago
A Fredericton man who had to undergo surgery to relieve pressure on his brain after he was assaulted in jail won’t get to go to trial with his lawsuit against the province.
Thomas William Jack, 45, of Fredericton, filed a notice of action and statement of claim in the Court of King’s Bench (then Queen’s Bench) in 2013 against the provincial government , seeking damages for serious injuries sustained while he was remanded at a provincial facility.
The lawsuit alleges Department of Public Safety staff at the Saint John Regional Correctional Centre failed in their duty to ensure his safety while he was remanded on pending criminal charges in 2011.
But that court action has come to a halt after the province filed a motion for dismissal recently.
