Judge admits complainant's video in sex case
Teenage girl’s recorded statement to police alleging Evan Sandwith, 22, of Rusagonis, sexually assaulted her in 2021 can be admitted at trial provided she adopts contents
A video recording of a minor’s statement to the RCMP alleging a Rusagonis man victimized her sexually on several occasions in 2021 can be admitted as part of her testimony, a judge ruled Monday.
Evan Sandwith, 22, of Noble Court in Rusagonis, will stand trial in the Court of King’s Bench beginning next week on 11 serious charges, including sexual assault, sexual assault with a weapon (a knife), sexual interference and invitation to sexual touching.
The charges allege offences against a teenage girl in Oromocto in August and September 2021.
There’s a court-ordered publication ban in place protecting the girl’s identity.
The Crown had previously brought an application before the court, seeking to have two witness statements, recorded on video at the RCMP detachment in Oromocto, admitted as evidence for the trial.
