The prosecution and defence recommended a conditional discharge with counselling for a disgraced provincial peace officer convicted of leaving a loaded firearm unsafely within reach of his children.

But the judge presiding over the case felt that might send the wrong message to the public.

Judge Kelly Winchester convicted Michael (Mike) Phillipe Breau, 35, of Wilsey Road in Rusagonis, in September of improper storage of a firearm.

The incident occurred March 29, 2022, at Breau’s involving his service weapon, issued by the Department of Justice and Public Safety as part of his previous employment as a public-safety officer.

The case was back in Fredericton provincial court Tuesday for a sentencing hearing.
