A Fredericton man found guilty last year of sexually assaulting a drunken woman at a party in 2017 lost his bid to overturn his conviction and has been ordered to surrender himself back into custody.

The New Brunswick Court of Appeal issued its decision Thursday in the case of Jacob Sterling Fairy, 32, of Forest Hill Road.

He was convicted after trial in May 2023 of an indictable count of sexual assault and sentenced to a federal-prison term of two years plus a day.

The identity of the woman he victimized is protected by a court-ordered publication ban.

The charge arose after an incident the night of Feb. 14, 2017, at the victim’s apartment.
