A provincial government peace officer left his loaded work pistol hanging in its holster on a coat rack in his living room, readily accessible by his unsupervised kids, a court heard Monday.

But his defence counsel argued a criminal charge against him can’t stand because the search that led to its discovery violated her client’s rights.

Michael (Mike) Phillipe Breau, 34, of Wilsey Road in Rusagonis, was scheduled to stand trial in Fredericton provincial court Monday on three charges.

The RCMP alleged he criminally harassed Michelle Russell between March 18 and 29, 2022, by observing her New Maryland home repeatedly; that he made unauthorized use of a computer system - namely, the province’s motor-vehicle and drivers database - in Rusagonis between Jan. 4 and March 24, 2022; and that he stored a firearm carelessly in Rusagonis on March 29, 2022.
