Criminal-responsibility finding at issue in sex case
Court hears language used in psychiatric assessment of Jarett Wayne Fraser Heuff, 26, was unclear, and prosecutor requests adjournment to consult with another psychiatrist
A developmentally delayed man from Pomeroy Ridge accused of sexual offences against a minor is likely exempt from criminal responsibility due to a mental disorder, says a psychiatric report.
Jarett Wayne Fraser Heuff, 26, of Clark Point Road in Pomeroy Ridge, about 50 kilometres south of McAdam, was back in Fredericton provincial court Monday, scheduled for a hearing on the issue of his criminal responsibility.
He’s accused of sexual assault and sexual interference involving an underage girl in McAdam between Oct. 30-31, 2021.
There’s a court-ordered publication ban in place protecting the complainant’s identity.
Defence lawyer Edward Derrah previously applied to the court to have Heuff undergo a forensic psychiatric assessment to determine if he might be exempt from criminal responsibility due to a mental disorder at the time of the alleged offences.
