A judge was taken aback last week when the Crown and defence made a joint sentencing recommendation of probation for a Fredericton man busted at the site of a business break-in.

James Boies, 39, of Perry Court, appeared in Fredericton provincial court Wednesday for a sentencing hearing, having previously pleaded guilty to counts of break and enter, possession of break-in instruments and mischief causing damage to property.

Crown prosecutor Monika Berenyi said the case arose after Fredericton police officers were dispatched to AIM Recycling on Carman Avenue at 2:22 a.m. Sept. 28 after receiving a report of a break-in in progress.
