An Oromocto man given the opportunity to avoid a trial or criminal record for a summary count of sexual assault didn’t complete a post-charge diversion program, court heard Monday.

Michael Upshall, 47, of Ripley Street, was charged earlier this year with a summary count of sexual assault, alleged to have occurred in in Oromocto on June 27, 2023.

There’s a court-ordered publication ban in effect protecting the identity of the complainant.

The Crown had agreed to allow Upshall to participate in a post-charge diversion program, which is administered by probation services and allows defendants facing less serious charges to avoid criminal records.
