Public masturbation draws probation

Crown, defence sought conditional sentence for Benjamin Miles Warren, 42, but judge found improvements in offender’s life made community-based jail term unnecessary

A man who was homeless in 2023 when he defiantly engaged in public masturbation has since secured stable housing and even has a job on the horizon, so a court decided probation was sufficient in his case.

Benjamin Miles Warren, 42, formerly of no fixed address, appeared in Fredericton provincial court Monday for sentencing for an incident act he committed two years ago.

Court heard earlier this year that the Fredericton police responded to the Queen Street parking garage on Oct. 5, 2023, after an attendant from the facility reported a man lying on the sidewalk with his genitals exposed.
