NB Liquor agency-store lawsuit nixed

After failed judicial-review application, Hartland Freshmart owner sued Crown corporation for awarding booze licence to competitor, but judge rules insufficient notice invalidates it

A Hartland business owner who’d sought to sue NB Liquor for awarding an agency-store contract to a competitor five years ago didn’t provide the required notice, a judge ruled recently, killing the court action.

However, the plaintiff has filed a notice of appeal to challenge that ruling.

Peter Cook, owner of Freshmart in Hartland, filed a notice of action and statement of claim against NB Liquor in the Court of King’s Bench in Fredericton in 2022 over the loss of the agency-store contract at his store, which was awarded to Hartland Valu Foods Inc., which operated a convenience store and gas station on the edge of the community.
