A manslaughter prosecution against a young Nova Scotia man took a surprising turn Monday, as the defendant admitted to a lesser crime: summary assault.

Tyler Totten, 19, of Lower Truro, N.S., was one of four defendants charged with manslaughter in the Sept. 27 death of André Bourgeois, 41, of Grande-Digue.

Totten was the sole adult defendant in the case, so he was being prosecuted separately from the other three, all teenage males whose identities are protected by the Youth Criminal Justice Act.

Though Bourgeois died Sept. 27, 2024, the Crown had alleged the precipitating event was a Sept. 22, 2024, assault in the Tannery, a courtyard in Fredericton’s downtown bar district.
