‘Human memory is rarely so precise’
Judge says defendant’s, alibi’s recall of events more than six years before, “almost down to the minute,” lacked credibility, rejects notion that victim had motive to fabricate allegations
A judge convicted a Zealand man recently of sexually assaulting his former common-law spouse six years ago, finding his denial and supposed alibi evidence to be lacking in credibility or believability.
A 55-year-old man from Zealand stood trial recently before Fredericton provincial court Judge Lyne Raymond on a March 27, 2019, charge of sexual assault, and the judge rendered her decision on the case Oct. 31.
The complainant in the case was the defendant’s former common-law spouse, and there’s a court-ordered publication ban in effect protecting her identity. As such, the Fredericton Independent isn’t naming the accused either so as to comply with the order.
As part of her oral decision, Raymond reviewed the evidence of the case and offered her assessment of the testimony presented to the court.
