A Fredericton man who’s been in custody since last summer for illegally entering his mother’s home uninvited and assaulting a mall security guard won’t have to serve any more jail time for his crimes.

David Justin Larlee, 49, of no fixed address, appeared in Fredericton provincial court in custody and in person Wednesday for a sentencing hearing.

He’d previously pleaded guilty to summary May 12 counts of assaulting John Arbeau, resisting arrest and breaching his probation.

The defendant had also pleaded guilty during an early appearance to a July 27 charge of break and enter into the home of Elizabeth Larlee, his mother, but prosecutor Megan Kervin told the court Wednesday the Crown was willing to accept a guilty plea to the lesser, included offence of unlawful entry.
