Appeal court rules sentencing judge erred when she declined to spare Michael (Mike) Phillipe Breau, 36, of Rusagonis, from having criminal record for March 2022 firearm offence

A former provincial safety officer who was fired in the wake of police discovering his work firearm loaded and unsecured around his kids won’t have a criminal record for the offence after all.

A judge found Michael (Mike) Phillipe Breau, 36, of Wilsey Road in Rusagonis, guilty after trial last year for improper storage of a handgun improperly.

Despite a joint recommendation from the Crown and defence for a conditional discharge, but provincial court Judge Kelly Winchester sentenced Breau to two years of probation, earning Breau a criminal record.

He appealed both the conviction and the sentence, and the parties presented their arguments on the appeal earlier this month before Justice Thomas Christie of the Court of King’s Bench, which handles summary appeals.
